1. Introduction

Welcome to Dubai Adventure Tours. These Terms and Conditions ("Terms") govern your access to and use of the Dubai Adventure Tours website, located at dubaitours.ae (the "Site"), and the services, features, content, applications, and products offered by Dubai Adventure Tours (collectively with the Site, the "Services").

By accessing or using our Services, you agree to be bound by these Terms. If you do not agree to these Terms, you may not access or use the Services. These Terms constitute a legally binding agreement between you and Dubai Adventure Tours.

Please read these Terms carefully before booking any tours or services. By making a booking with Dubai Adventure Tours, you confirm that you have read, understood, and agree to these Terms in their entirety.

2. Definitions

Throughout these Terms, the following definitions apply:

• "We", "us", "our" refers to Dubai Adventure Tours, a company registered in the United Arab Emirates (Registration No: 78190390).
• "You", "your" refers to the person or entity accessing our Site, using our Services, or making a booking with us.
• "Tour" refers to any activity, experience, excursion, or service offered by us, either directly or through third-party providers.
• "Booking" refers to the reservation of any Tour through our Site, by telephone, email, or other means.
• "Confirmation" refers to our written acceptance of your Booking, sent via email or other electronic means.
• "Participant" refers to any person who takes part in a Tour, including you and any person on whose behalf you make a Booking.

3. Booking and Payment

3.1 Booking Process

To make a Booking, you must:

• Provide all required personal and payment information
• Be at least 18 years old or have the consent of a parent or guardian
• Have the legal authority to make the Booking

A contract between you and Dubai Adventure Tours will only come into existence when we issue a Confirmation. Until a Confirmation is issued, no contract exists between you and Dubai Adventure Tours.

3.2 Booking Information

You are responsible for ensuring that all information provided during the Booking process is accurate and complete. This includes, but is not limited to:

• Contact details (name, email, phone number)
• Participant information (names, ages, special requirements)
• Selected Tour dates, times, and options

We reserve the right to cancel a Booking without refund if inaccurate information is provided.

3.3 Payment

Full payment is required at the time of Booking unless otherwise stated. All prices are listed in US Dollars (USD) and include applicable taxes unless otherwise stated.

We accept payment by major credit cards (Visa, MasterCard, American Express), PayPal, and other methods as indicated on our Site. By providing your payment information, you represent and warrant that you are authorized to use the designated payment method.

3.4 Pricing and Errors

We make every effort to ensure that the prices listed on our Site are accurate. However, if a pricing error occurs:

• We reserve the right to correct the price and offer you the option to cancel your Booking for a full refund.
• If the correct price is lower than our stated price, we will charge the lower amount.
• If the correct price is higher than our stated price, we will contact you before proceeding with your Booking.

Prices may change at any time, but changes will not affect Bookings already confirmed with a Confirmation, except in cases of obvious error.

4. Cancellations and Modifications

4.1 Cancellation by You

Cancellation policies vary by Tour and are specified in the Tour description or during the Booking process. In general, the following cancellation policies apply:

• More than 48 hours before the Tour: Full refund minus any non-refundable deposits or third-party charges.
• 24-48 hours before the Tour: 50% refund.
• Less than 24 hours before the Tour: No refund.

All cancellation requests must be submitted in writing to info@dubaitours.ae. The date and time of receipt of the cancellation request will determine the applicable cancellation policy.

4.2 Cancellation by Us

We reserve the right to cancel a Tour under the following circumstances:

• Insufficient participants to operate the Tour
• Operational issues that prevent us from providing the Tour safely
• Force majeure events (as defined in Section 8)
• Your failure to comply with these Terms or any applicable laws or regulations

If we cancel a Tour, we will offer you the choice of:

• A full refund of the amount paid; or
• An alternative Tour of equivalent or superior quality, if available; or
• An alternative Tour of lower quality, if available, with a price difference refund.

4.3 Modifications

Requests to modify a Booking (such as date changes or participant changes) must be submitted in writing to info@dubaitours.ae. We will make reasonable efforts to accommodate modifications but cannot guarantee that all requests will be fulfilled.

Modification requests are subject to availability and may incur additional charges. Modifications made less than 48 hours before the Tour are treated as a cancellation and new Booking, subject to the cancellation policy in Section 4.1.

4.4 No-Show

If you or any Participant fails to arrive for a Tour at the designated time and location ("No-Show"), no refund will be provided, and you will be charged the full amount of the Booking.

5. Tour Participation and Conduct

5.1 Participant Requirements

For all Tours, Participants must:

• Arrive at the designated meeting point at least 15 minutes before the scheduled Tour time
• Bring valid identification (passport or government-issued ID)
• Meet any age, health, or fitness requirements specified for the Tour
• Adhere to the dress code and equipment requirements specified for the Tour
• Inform us of any medical conditions, allergies, or special needs at the time of Booking

5.2 Participant Conduct

All Participants must:

• Comply with all instructions from Tour guides, staff, and representatives
• Respect local customs, traditions, and practices
• Behave in a manner that does not disrupt the Tour or cause discomfort to other Participants
• Refrain from engaging in any illegal or inappropriate activity during the Tour
• Refrain from consuming alcohol or drugs before or during activities that require physical coordination

We reserve the right to refuse participation or discontinue Tour services for any Participant whose conduct is deemed inappropriate, disruptive, or presents a risk to themselves or others. In such cases, no refund will be provided.

5.3 Photography and Content

During Tours, our staff may take photographs or videos for promotional purposes. By participating in a Tour, you grant Dubai Adventure Tours the right to use such content featuring you or other Participants for marketing and promotional purposes without compensation.

If you do not wish to be photographed or filmed, please inform the Tour guide at the beginning of the Tour.

5.4 Children and Minors

Children under 18 years must be accompanied by a parent or guardian who is responsible for their supervision and conduct throughout the Tour. Specific age restrictions for certain Tours are indicated in the Tour descriptions.

For safety reasons, some Tours may not be suitable for children under a certain age. We reserve the right to refuse participation if minimum age requirements are not met.

6. Health and Safety

6.1 Participant Health

You must inform us at the time of Booking if you or any Participant has any medical condition, disability, or special need that may affect participation in the Tour. We will make reasonable efforts to accommodate special requirements, but cannot guarantee that all requests can be fulfilled.

Participants are responsible for ensuring they are physically fit and healthy enough to participate in the Tour. Some Tours may involve physical activities or take place in challenging environments, and Participants should consider their own capabilities before booking.

6.2 Safety Instructions

For your safety, all Participants must:

• Attend safety briefings provided before activities
• Use all provided safety equipment correctly
• Follow safety instructions given by Tour guides and staff
• Inform Tour guides of any discomfort, injury, or concern during the Tour

Failure to comply with safety instructions may result in exclusion from the Tour without refund.

6.3 Insurance

We strongly recommend that all Participants obtain comprehensive travel insurance, including coverage for medical expenses, personal accidents, cancellation, and loss of personal belongings.

Dubai Adventure Tours does not provide insurance coverage for Participants. Your participation in Tours is at your own risk.

7. Liability and Disclaimers

7.1 Our Liability

We will exercise reasonable care and skill in providing our Services. However, to the fullest extent permitted by law, Dubai Adventure Tours shall not be liable for:

• Any indirect, consequential, special, or punitive damages
• Any loss of enjoyment, opportunity, profit, or savings
• Personal injury, illness, or death that is not caused by our negligence
• Loss, theft, or damage to personal belongings during Tours
• Any issues arising from circumstances beyond our reasonable control
• The acts or omissions of third-party providers (such as transportation services, venues, or activity operators)

Our maximum liability for any claim shall be limited to the total price paid for the Booking.

7.2 Third-Party Providers

Some Tours may be operated by third-party providers. While we select our partners carefully, we cannot accept liability for the acts or omissions of third-party providers. Any claims relating to services provided by third parties should be directed to the relevant provider.

7.3 Assumption of Risk

By booking and participating in a Tour, you acknowledge that certain activities involve inherent risks. These may include, but are not limited to:

• Outdoor activities in variable weather conditions
• Adventure activities (such as desert safaris, water sports, or camel riding)
• Transportation in various vehicles
• Interaction with animals
• Physical exertion or activity

You voluntarily accept these risks and agree that Dubai Adventure Tours will not be liable for any resulting injury, illness, or death, except in cases of our negligence.

7.4 Site Content and Availability

We make reasonable efforts to ensure that the information on our Site is accurate and up-to-date. However, we do not guarantee that the Site will be error-free, complete, or continuously available.

We reserve the right to modify, suspend, or discontinue any aspect of the Site at any time without notice. We shall not be liable for any loss or damage arising from any inability to access the Site or from any use of the Site.

8. Force Majeure

Dubai Adventure Tours shall not be liable for any failure to perform or delay in performance of our obligations under these Terms arising from circumstances beyond our reasonable control, including but not limited to:

• Acts of God (such as floods, earthquakes, storms)
• War, civil unrest, or terrorist activity
• Public health emergencies or pandemics
• Government actions or restrictions
• Labor disputes or strikes
• Utility failures or transportation disruptions
• Supplier or third-party provider failures

If a force majeure event occurs, we may:

• Reschedule the Tour to a later date
• Offer an alternative Tour of equivalent value
• Issue a credit for future use
• Provide a refund less any non-refundable expenses already incurred

9. Intellectual Property

All content on the Site, including text, graphics, logos, images, audio clips, digital downloads, data compilations, and software, is the property of Dubai Adventure Tours or our content suppliers and is protected by international copyright laws.

The trademarks, service marks, logos, and trade names displayed on the Site are registered and unregistered trademarks of Dubai Adventure Tours and others. Nothing contained on the Site should be construed as granting any license or right to use any trademark without prior written permission.

You may not reproduce, distribute, modify, create derivative works from, publicly display, publicly perform, republish, download, store, or transmit any material from our Site, except:

• Your computer may temporarily store copies of materials in RAM incidental to your accessing and viewing those materials
• You may store files that are automatically cached by your web browser for display enhancement
• You may print or download one copy of a reasonable number of pages of the Site for your personal, non-commercial use and not for further reproduction, publication, or distribution

10. Privacy and Data Protection

We collect and process your personal information in accordance with our Privacy Policy, which is incorporated into these Terms by reference. By using our Services, you consent to the collection, use, and sharing of your information as outlined in the Privacy Policy.

11. Governing Law and Jurisdiction

These Terms shall be governed by and construed in accordance with the laws of the United Arab Emirates, without giving effect to any principles of conflicts of law.

Any dispute arising out of or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts of Dubai, United Arab Emirates.

12. Modifications to Terms

We reserve the right to modify these Terms at any time. Any changes will be effective immediately upon posting the updated Terms on the Site. Your continued use of our Services after such modifications constitutes your acceptance of the revised Terms.

It is your responsibility to review these Terms periodically. The date of the last modification is stated at the top of these Terms.

For Bookings made before a change to these Terms, the version of the Terms in effect at the time of Booking will apply to that Booking.

13. Miscellaneous

13.1 Entire Agreement

These Terms, together with the Privacy Policy and any Booking Confirmation, constitute the entire agreement between you and Dubai Adventure Tours regarding the Services and supersede all prior agreements and understandings, whether written or oral.

13.2 Severability

If any provision of these Terms is held to be invalid, illegal, or unenforceable, the remaining provisions shall continue in full force and effect.

13.3 No Waiver

Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights. Any waiver of any provision of these Terms will be effective only if in writing and signed by an authorized representative of Dubai Adventure Tours.

13.4 Assignment

You may not assign or transfer these Terms or your rights and obligations under these Terms without our prior written consent. Dubai Adventure Tours may assign or transfer these Terms without restriction.
